  1. Acceptance of the Terms

By accessing the website, placing an order and/or checking the relevant boxes at checkout, the customer declares that they have read, understood, and accepted these Terms and Conditions.

These terms apply to all orders placed through the website.

  1. Products Offered for Sale

The website offers physical books and digital e-book products for sale. Each product is presented with a description, price, and, where applicable, available options. Information regarding the main characteristics of each product must be clearly communicated before the order is completed.

We make every effort to ensure that the information displayed on the website is accurate and up to date. However, display errors regarding description, availability, or price may occur. In such cases, we reserve the right to correct the information and to notify the customer before processing the order.

  1. Prices and Invoicing

All prices displayed on the website are expressed in RON/EUR and include applicable taxes, unless otherwise stated.

The delivery cost is RON 20 and is displayed separately before the order is finalized. The law requires that the total price and any additional costs be displayed before the user becomes contractually bound.

The invoice is issued based on the information provided by the customer in the order form. The customer is required to enter real, complete, and accurate information.

  1. Placing an Order and Conclusion of the Contract

To purchase a product, the customer selects the desired product, adds it to the cart, fills in the required information, and completes the order using the available payment method.

After the order is placed, the customer receives an email confirming that the order has been registered. This confirmation does not automatically constitute the seller’s final acceptance of the order, but only its registration in the system.

The contract shall be deemed concluded when the order is confirmed by the seller and/or when payment is confirmed, following verification of product availability and the accuracy of the information provided.

We reserve the right to refuse or cancel orders in justified cases, including, but not limited to, suspicious transactions, incomplete or incorrect data, products displayed incorrectly due to technical errors, or lack of stock availability.

  1. Payment Methods

Payment for products is made online by card through the Stripe payment processor, as displayed on the website, or by bank transfer to account RO47INGB0000999917512251.

If the transaction is declined by the payment processor or the issuing bank, the order will not be completed.

We do not store and do not have direct access to the full details of the bank card used for payment.

  1. Delivery

7.1. Physical books

Physical products are delivered by courier to the address indicated by the customer in the order.

The estimated delivery time is 5 business days from payment confirmation, unless a different timeframe is specified on the product page or at checkout.

Unless otherwise agreed, the trader must deliver the goods without undue delay and, in any event, no later than 30 days from the conclusion of the contract.

The customer is required to verify the accuracy of the delivery details entered. We are not liable for delays or failure to deliver caused by incomplete or incorrect information provided by the customer.

7.2. E-book

E-books are delivered exclusively in electronic format, by email, through a user account, via download link, or by any other method indicated on the website, after payment confirmation.

For digital content not supplied on a tangible medium, the trader must also provide information regarding functionality and interoperability where such information is relevant.

The estimated delivery time for an e-book is immediate upon payment confirmation, except in the event of unforeseen technical issues.

  1. Right of Withdrawal for Individuals

According to Government Emergency Ordinance no. 34/2014, the consumer benefits from a 14-day period to withdraw from a distance contract without being required to justify the decision. In the case of goods, this period starts on the date on which the consumer, or a person indicated by them, takes physical possession of the product.

To exercise the right of withdrawal, the customer must send an unequivocal statement to the email address contact@claudiusimion.ro.

The customer must return the product within a maximum of 14 days from the date the withdrawal is communicated. The seller shall reimburse the amounts paid within no more than 14 days from the date on which it was informed of the withdrawal, using the same payment method, but may withhold the reimbursement until the returned goods have been received or until proof of dispatch has been provided, unless the seller has offered to recover the goods itself.

The customer bears the direct cost of returning the product, provided that the website informs them of this in advance.

  1. Exception to the Right of Withdrawal for E-books

For digital e-book products supplied electronically and not delivered on a tangible medium, the right of withdrawal is lost if performance has begun during the legal withdrawal period and the customer:

  1. has given prior express consent for the supply to begin;
  2. has confirmed that they understand they will lose their right of withdrawal.
  1. Return of Physical Products

The product must be returned in the same condition in which it was delivered, without unjustified damage. The customer is only liable for any diminished value of the product resulting from handling beyond what is necessary to determine the nature, characteristics, and functioning of the product. This principle derives from the rules on withdrawal and reimbursement set out in GEO no. 34/2014.

  1. Non-conforming, Incorrect, or Damaged Products

If the delivered product is incorrect, damaged, or non-conforming, the customer is requested to contact us as soon as possible at contact@claudiusimion.ro stating the order number and a description of the issue, ideally accompanied by photographs.

For physical goods sold to consumers, the seller is liable for any lack of conformity existing at the time of delivery that becomes apparent within 2 years from the date of delivery. In the event of non-conformity, the consumer is entitled to have the goods brought into conformity free of charge, within a reasonable period not exceeding 15 calendar days, and if the contract is terminated, the seller shall refund the price upon receipt of the goods or proof of return, using the same payment method.

  1. Intellectual Property

The entire content of the website, including, but not limited to, texts, images, graphics, cover artwork, descriptions, design elements, logo, and digital materials, belongs to SIMION CORNELIU CLAUDIU PFA or is used based on lawful rights of use.

Copying, distributing, publishing, transmitting, modifying, or otherwise using the content without the prior written consent of the rights holder is prohibited.

In the case of e-books, the purchase grants the customer a personal, non-exclusive, and non-transferable right of use for personal reading only. Reproduction, redistribution, resale, sharing, or making the digital files available to third parties, in whole or in part, is prohibited.

  1. Liability

We do not guarantee that the website will operate without interruptions or permanent technical errors, but we make reasonable efforts to maintain its proper functioning.

We are not liable for damages resulting from improper use of the website, temporary inability to access it, technical errors of third parties, issues concerning the payment processor, internet service providers, or courier operators, to the extent permitted by law.

This clause does not limit the rights of consumers provided by the applicable legislation.

  1. Privacy Policy

The processing of personal data is carried out in accordance with the Privacy Policy published on the website.

By placing an order, the customer confirms that they have taken note of this policy.

  1. Complaints and Dispute Resolution

For any notification or complaint, you may contact us at contact@claudiusimion.ro

If a complaint is not resolved amicably, consumers may use alternative dispute resolution mechanisms through SAL ANPC. Your website already includes a link to this option in the footer.

You may also refer to the European Consumer Redress portal as a current informational page, but without describing the former ODR platform as active, since it has been closed.

  1. Applicable Law

These Terms and Conditions are governed by Romanian law.

  1. Amendment of the Terms

We reserve the right to amend these Terms and Conditions whenever necessary. The updated version will be published on the website and shall take effect from the date of publication.
